These Terms of Service ("Terms") govern your access to and use of the Triune Business Solutions platform, including our website, mobile applications, social media management services, and our Postiz social media scheduling platform at postiz.triunesolutions.biz (collectively, the "Service").

2. Description of Service

Triune Business Solutions is a comprehensive business solutions provider offering various services including business consulting, website development, mobile app development, and social media management. As a key component of our social media management services, we operate a customized instance of the open-source Postiz platform at postiz.triunesolutions.biz.

Our Postiz platform provides users with tools to:

• Create, schedule, and publish content across multiple social media platforms
• Manage multiple social media accounts from a unified dashboard
• Analyze social media performance and engagement metrics
• Collaborate with team members on social media campaigns
• Access advanced social media management features and automation tools
• Generate reports and insights on social media performance

3. Postiz Platform and Open Source Software

Our Postiz platform is based on the open-source Postiz software, which we have customized, hosted, and maintained to provide enhanced functionality for our clients. While the underlying software is open-source, our specific implementation, customizations, hosting infrastructure, and additional features are proprietary to Triune Business Solutions.

By using our Postiz platform, you acknowledge that:

• The platform is provided as a managed service by Triune Business Solutions
• We may modify, update, or enhance the platform's features and functionality
• Your use is subject to these Terms of Service and our Privacy Policy
• We provide technical support and maintenance for the platform

4. Social Media Platform Integration

Our Service and Postiz platform integrate with various third-party social media platforms, including but not limited to Facebook, Instagram, Twitter/X, LinkedIn, TikTok, YouTube, Pinterest, and others. By using these integration features, you also agree to comply with the respective Terms of Service and Community Guidelines of each connected platform.

You acknowledge that:

• We are not affiliated with, endorsed by, or sponsored by any third-party social media platforms
• Your use of social media integration features is subject to each platform's policies and terms
• Third-party platforms may change their APIs, terms, or policies at any time, which could affect our Service's functionality
• We are not responsible for any changes, limitations, or restrictions imposed by third-party platforms
• You must comply with all applicable platform-specific rules, guidelines, and content policies

5. Account Registration and Security

To use certain features of the Service and Postiz platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process
• Update such information to keep it accurate, current, and complete
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You are responsible for safeguarding the password and any other credentials you use to access the Service. You agree not to disclose your credentials to any third party and to take sole responsibility for any activities or actions under your account.

6. User Content and Social Media Posts

Our Service and Postiz platform allow you to create, upload, schedule, and publish content, including text, photos, videos, and other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you create and publish through the Service.

By using our Service and Postiz platform, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, copy, modify, and distribute your User Content as necessary to provide the Service
• The right to schedule and publish your User Content to connected social media platforms on your behalf
• The right to store, backup, and secure your User Content on our servers
• The right to analyze your User Content for performance metrics and insights

You represent and warrant that:

• You own or have the necessary rights to all User Content you submit
• Your User Content does not violate any third-party rights or applicable laws
• Your User Content complies with the community guidelines and terms of service of connected social media platforms

7. Acceptable Use Policy

You agree not to use the Service or Postiz platform to:

• Violate any applicable laws, regulations, or third-party rights
• Post, schedule, or publish illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Engage in spam, unsolicited advertising, or bulk messaging
• Impersonate another person, entity, or brand without authorization
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers and networks connected to the Service
• Use automated means to access the Service without our express written permission
• Reverse engineer, decompile, or attempt to extract source code from our proprietary software

8. Subscription Plans and Payment Terms

Our Postiz platform and certain features of our Service may be offered under various subscription plans. By subscribing to a paid plan, you agree to:

• Pay all applicable fees and charges associated with your chosen plan
• Provide accurate and complete billing information
• Authorize us to charge your chosen payment method for recurring subscription fees
• Notify us of any changes to your payment information

Subscription fees are billed in advance and are non-refundable except as required by law or as specifically stated in our refund policy. We reserve the right to modify our pricing and subscription plans with reasonable notice to existing subscribers.

9. Data Backup and Service Availability

While we implement robust backup and security measures for our Postiz platform and Service, you acknowledge that:

• You are responsible for maintaining your own backups of important User Content
• We strive for high availability but cannot guarantee 100% uptime
• Scheduled maintenance may temporarily affect service availability
• We are not liable for any data loss or service interruptions beyond our reasonable control

10. Intellectual Property Rights

The Service, Postiz platform, and their original content (excluding User Content), features, and functionality are and will remain the exclusive property of Triune Business Solutions and its licensors. The Service is protected by copyright, trademark, and other laws.

While our Postiz platform is based on open-source software, our specific customizations, branding, additional features, and hosting infrastructure are proprietary to Triune Business Solutions.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Our Service and Postiz platform may integrate with or provide access to third-party services, APIs, and platforms. We are not responsible for:

• The availability, functionality, or performance of third-party services
• The content, privacy practices, or terms of service of third-party platforms
• Any fees, charges, or costs associated with third-party services
• Any data loss or security issues related to third-party integrations

12. Limitation of Liability

In no event shall Triune Business Solutions, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service or Postiz platform
• Any conduct or content of any third party on the Service
• Any content obtained from the Service or third-party platforms
• Unauthorized access, use, or alteration of your transmissions or content
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar harmful components that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

13. Indemnification

You agree to defend, indemnify, and hold harmless Triune Business Solutions and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service or Postiz platform
• Your User Content or social media posts
• Your violation of any rights of another party

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to:

• Breach of these Terms
• Violation of our Acceptable Use Policy
• Non-payment of fees
• Fraudulent or illegal activity
• Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. We may, at our discretion, provide you with a reasonable opportunity to export your User Content before account deletion.

15. Changes to Terms and Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We may also modify, update, or discontinue features of our Service or Postiz platform. If a revision to these Terms is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

16. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration or in the courts of Ghana.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
